Binasura ng korte suprema ang petition ng mga pribadong hospital at mga clinic na kumukwestiyon sa pagpapatibay ng Anti-Hospital Deposit Law. Ayon sa naging desisyon ng Korte Suprema hindi kaylangan aksyonan ng petition ng Private Hospital Association of the Philippines dahil wala na direktang negatibong epekto ang batas sa groupo para kuwestiyonin ito. Naghain ang groupo noong 2017 para hikayatin ang korte na gawing UN-constitutional ang RA 10932.
PHAPi filed the petition in 2017 soon after President Duterte signed RA 10932 into law in Aug. 2017. RA. 10932 amended PA 8344 or the Anti-Hospital Deposit Law by expanding the scope of emergency cases to include that of a woman giving birth.
It also increased the penalties to erring medical officials, practitioners or employees to up to 2 years and 4 months imprisonment and up to P300,000 in fines, and up to 6 years imprisonment ang P1million in fines to the director or officer who formulated a policy in violation of the provisions of the law.
